Terms of Service
Last updated: June 2025
These Terms of Service describe how HomeLyft Restoration MS provides residential and commercial restoration services in the Gulf Coast region. By requesting an estimate, signing a work-authorization form, or engaging our services in any way, you agree to the terms outlined here. If you have questions before work begins, reach us at [email protected] or (228) 284-5200.
Service Area
HomeLyft Restoration MS operates out of Gulfport, Mississippi and serves properties within our defined service area along the Mississippi Gulf Coast. We reserve the right to decline service requests outside that area or where site conditions make safe operations impractical. Contacting us does not guarantee service availability at your specific location — we’ll confirm coverage when you call or submit an inquiry.
Estimates and Work Authorization
Any estimate, quote, or scope of work we provide — whether delivered verbally, by email, or in a written document — is an assessment only. It does not constitute a binding contract. The legal agreement governing your project begins when you sign a written work-authorization form. That signed form defines the approved scope, agreed pricing, and project timeline. Work will not begin until authorization is in place. Scope changes discovered during remediation (hidden moisture, concealed structural damage, additional mold colonies behind walls) will be documented and require a signed change order before additional work proceeds.
Payment Terms
Payment terms are stated on your work-authorization form and invoice. We accept payment by check, major credit cards, and electronic transfer unless otherwise arranged in writing. For insurance-coordinated projects, payment timelines follow the carrier’s claim schedule as agreed upon at project start. Outstanding balances not paid within the period stated on your invoice may be subject to late fees as permitted under Mississippi law.
Insurance Coordination
We work alongside most major property insurance carriers and can document losses, photograph affected materials, and communicate directly with adjusters — but only with your explicit written authorization. We do not guarantee any specific claim outcome, coverage determination, or reimbursement amount. Insurance coordination is a service we provide as a convenience; the contractual relationship for payment remains between you and your carrier.
Liability and Licensing
HomeLyft Restoration MS operates as a licensed contractor under Mississippi state regulations. Our liability is limited to the scope of work described in your signed work-authorization form. We are not responsible for pre-existing conditions, latent defects unrelated to the documented loss, or damage resulting from delays caused by insurance approvals, material availability, or circumstances outside our control. Nothing in these terms limits liability for gross negligence or willful misconduct as defined under Mississippi law.
Dispute Resolution
If a dispute arises from services provided under a signed work-authorization form, both parties agree to first attempt resolution through good-faith written communication. If informal resolution fails, disputes will be governed by the laws of the State of Mississippi, with venue in Harrison County. These terms do not waive any rights you hold under applicable state consumer protection statutes.
